That does look like a loophole. The whole idea about having different store is to take control away from them. If they still decide what can go in and what can not what is the point of side loading?
If the EU mandated it from Apple, how are Google managing to get around that?

Even if they found a loophole, the loophole would be closed, otherwise apple would do the same.
