Seems weird to try to attack from the angle that the model constitutes a copy rather than a derivative work. I’m sure Getty’s lawyers have their reasons why they didn’t try that route instead, but I’d be quite interested in seeing whether machine learning models trained on copyrighted data should be considered similarly to something like a piece of music sampling another piece (which my non-lawyer intuition says they should).
